Implications of Separation or Divorce on your Will

Marriage revokes a will but Divorce does not revoke a Will.

If, in the unfortunate circumstances, you separate from your spouse it does not mean that your spouse automatically loses their right to benefit under your estate.  For more information on a spouse's entitlement under your Will or on intestacy see the section on the legal right share of a spouse.

Whether are not they have a right will depend on the terms of the separation/judicial separation agreement, or divorce. If you are separated and are completing your Will you should furnish your solicitor with a copy of your signed separation agreement/divorce.
